Wrongful death claims in Florida are not like simple negligence claims.  They are specifically governed under the Florida Wrongful Death Act, Florida Statutes 768.16 to 786.26.  That Act essentially allows family members of the decedent to collect damages for medical expenses prior to death, loss of companionship and loss of future wages.  What makes wrongful death unique is that any claim for the same must be brought by the personal representative of the estate appointed by a probate court.  Unlike most negligent cases in Florida, there is only a two year statute of limitations in which to file the same.  Therefore, you should seek the immediate assistance of  an wrongful death attorney should you believe you have a claim for the same.
